I then went into the Hospital. I went straight forward to where Peak was.

He was standing on the floor and had a strong smell of drink on him.

Mr. Craig asked me if I thought that Peak was fit for duty.

"du ty",

That was said in the hearing of Peak.

I answered "No. I think he is unfit for night duty".

I was close up at Peak's side when that conversation took place.

Peak said he was not the worse for liquor, and that he was just as fit for duty that night as he was on any other night.

Craig said nothing to that.

I then went away with Craig leaving Peak in charge of the hospital ward.

About 10.25 Chief Warder Pierpoint visited the Prison, and he gave me orders to post another warder in the hospital.

I did so.

I posted an Indian Warder there.

Pierpoint, Peak, and I went straight down to the main gate of the gaol.

There at 10.40 I locked the main gate and locked up the prison.

Peak's quarters were outside the prison in Hollywood Road.
